Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs how you may use Faishon.studio and the content you may generate on our platform. It applies to all users , individuals, brands, and partners , and supplements our Terms of Use. By using Faishon.studio, you agree to comply with this Policy.

1Identity and Likeness Protection

We take the protection of personal identity and likeness seriously. To prevent misuse of generative AI:

• All models featured on Faishon.studio are 100% AI-generated synthetic individuals. None are based on real, identifiable people.
• You may not use the platform to recreate, replicate, or approximate the likeness of any real, named, or identifiable individual , including public figures, celebrities, or private persons , in any generated output.
• You may upload photographs containing real people (for example, on-model garment photographs) solely as garment, styling, or background references. Faces and likenesses in uploaded reference images are not reproduced in outputs; all generated models are synthetic.
• Where any Uploaded Content contains the image or likeness of a real person, you represent and warrant that you have obtained that person's valid, verifiable consent (including a model release or equivalent permission where applicable) for the upload and processing of their image on this platform. You are solely responsible for obtaining and maintaining such consents, and any claim arising from the absence of such consent is covered by the indemnification obligations in Section 3.
• The creation of deepfakes, non-consensual intimate imagery (NCII), or any content intended to impersonate or deceive is strictly prohibited.

2Content Safety

To ensure the integrity of generated outputs:

• Every image or video generated through Faishon.studio is automatically screened by our NSFW classifier. Outputs flagged as containing nudity or sexually explicit material are blocked from delivery.
• The platform is designed and intended for fashion ecommerce imagery , apparel and intimate apparel (including lingerie and swimwear) consistent with mainstream catalog standards comparable to imagery published by leading fashion retailers.

3Uploaded Content: Ownership, Rights, and Indemnity

By uploading any image, garment photograph, product photograph, sketch, logo, or other material ("Uploaded Content") to Faishon.studio, you represent and warrant that:

• You are the sole owner of the Uploaded Content, or you hold all licenses, rights, consents, and permissions necessary to upload it and to authorize its use by Faishon.studio for the purpose of generating outputs;
• The Uploaded Content, and our processing of it as directed by you, does not and will not infringe, misappropriate, or violate any third party's intellectual property rights (including copyright, trademark, and design rights), publicity or personality rights, privacy rights, or any applicable law;
• Where the Uploaded Content contains the image or likeness of any person, you have obtained that person's valid, verifiable, and informed consent (including a model release or equivalent permission where applicable) for such upload and processing.

Indemnification. You agree to indemnify, defend, and hold harmless 3rd i Visuals Pvt. Ltd., its directors, officers, employees, and agents from and against any and all claims, demands, actions, proceedings, losses, damages, liabilities, penalties, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your Uploaded Content; (b) any breach of the representations and warranties in this Section or in Section 1; (c) your use of the platform in violation of this AUP, our Terms of Use, or applicable law; or (d) any third-party claim that your Uploaded Content or your use of generated outputs infringes or violates that third party's rights.

Faishon.studio acts as a technology service provider processing content at your direction. We do not review, verify, or endorse Uploaded Content, and we bear no responsibility or liability for it. We reserve the right (but have no obligation) to remove any Uploaded Content and to suspend or terminate accounts in connection with actual or suspected infringement, including in response to takedown notices from rights holders.

4Generated Outputs: Ownership and Commercial Use

• Subject to your compliance with this AUP, our Terms of Use, and payment of all applicable fees, Faishon.studio grants you full rights to use images and videos generated from your Uploaded Content ("Generated Outputs") for any lawful purpose, including commercial use , such as ecommerce listings, marketplace catalogs, advertising, social media, and marketing materials , without attribution and without further payment to us.
• Your rights in Generated Outputs are conditional on your rights in the underlying Uploaded Content. If you did not have the rights to the Uploaded Content, no rights in the corresponding Generated Outputs are granted, and you remain solely liable for any resulting claims.
• You may not use Generated Outputs in any manner prohibited by this AUP, including to deceive, impersonate, or misrepresent a synthetic model as a real, identifiable person.
• Faishon.studio retains the right to retain and process Generated Outputs and associated logs for platform operation, safety screening, abuse investigation, and legal compliance, as described in Section 6.

5Prohibited Use

You may not use Faishon.studio to create, request, or distribute:

• Child sexual abuse material (CSAM). We have a zero-tolerance policy and report violations to applicable authorities.
• Imagery or video recreating the likeness of real individuals without verifiable consent, including deepfakes and non-consensual intimate imagery.
• Sexual or explicit content beyond catalog-standard fashion imagery.
• Content that infringes any third party's intellectual property or other rights.

6Enforcement

We reserve the right to suspend or terminate any account that violates this AUP, our Terms of Use, or applicable law. Severe violations , including CSAM, NCII, or deepfake creation , will result in immediate termination and may be reported to relevant authorities. Generated content is logged and may be reviewed in connection with abuse investigations.

7Reporting Abuse

If you believe content generated on Faishon.studio violates this Policy or your rights, please contact us at support@faishon.studio. We aim to respond within 48 hours of receiving a report. Reports of CSAM or NCII are prioritized for immediate review.

Rights holders may submit infringement notices to the same address with: (a) identification of the work claimed to be infringed; (b) the URL or identifier of the allegedly infringing content; and (c) your contact details and a good-faith statement of infringement.

8Changes to This Policy

We may update this Acceptable Use Policy from time to time to reflect changes in our platform, applicable law, or industry best practices. The "Last Updated" date above reflects the most recent revision. Continued use of the platform after updates constitutes acceptance of the revised Policy.
