Welcome to Faishon.studio, a platform operated by 3rd i Visuals Pvt. Ltd. ("Faishon.studio", "we", "us", or "our"), based in Bangalore, India. These Terms of Use ("Terms") govern your access to and use of our website, products, and services. By using Faishon.studio, you agree to these Terms in full, together with our Acceptable Use Policy, which is incorporated into these Terms by reference.
Acceptance of Terms
By creating an account or using Faishon.studio, you acknowledge that you have read, understood, and agreed to these Terms and our Acceptable Use Policy. If you do not agree with any part of these Terms, please do not use the platform.
Eligibility and Account Access
Faishon.studio is intended for professional and commercial use by businesses, brands, and sellers. You must be at least 18 years old to use our services.
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account, including compliance with these Terms by anyone accessing the platform through your account.
Each individual or business is entitled to one account with free trial credits. Creating multiple accounts to obtain additional free credits is prohibited and may result in suspension of all associated accounts.
Platform Availability and Beta Status
Faishon.studio is currently available on an invite-only basis. Features, pricing, and availability may change as the platform evolves. We may add, modify, or discontinue features at any time. Where a change materially affects paid functionality, we will make reasonable efforts to notify users in advance via email or in-app notice.
Service Overview
Faishon.studio allows users to generate AI-powered on-model fashion photography and videos from garment inputs, including flat-lay/packshot photographs and on-model reference photographs. Features include multi-pose shoot generation, model selection and saved brand models, styling and background direction, and video generation. All models featured on the platform are AI-generated synthetic individuals, as described in our Acceptable Use Policy.
Credits, Payments, and Pricing
Prepaid credit model. Faishon.studio operates on a prepaid, pay-per-use credit system. You purchase credit packs and credits are deducted as you generate content. Current pack sizes, prices, and per-generation credit costs are displayed on our pricing page and within the platform, and may be revised from time to time. Credits already purchased are honoured at the credit balance you hold; price revisions apply to future purchases and future per-generation credit costs.
Payments. Payments are processed by our third-party payment partner (currently Razorpay). We do not store or have access to your card or payment instrument details. Indian users may register a GST number to receive GST-compliant tax invoices.
Credit validity. Purchased credits are valid for 12 months. Each new credit purchase extends the validity of your entire remaining credit balance to 12 months from the date of that purchase.
Failed generations. If a generation fails due to a platform error, the credits for that generation are not charged or are automatically returned to your balance.
Credits are not money. Credits are a prepaid usage entitlement for Faishon.studio services only. They have no cash value, are non-transferable between accounts, and cannot be exchanged, resold, or redeemed for cash.
Free Trial Credits and Watermarking
New accounts receive complimentary trial credits (currently 25) to evaluate the platform. Trial credits provide access to all platform features; however, images and videos generated using trial credits carry a visible watermark on download.
Watermarked outputs are provided for evaluation and internal review purposes only and may not be used commercially or published. Removing, cropping, obscuring, or otherwise circumventing the watermark is prohibited.
Upon your first purchase of any prepaid credit pack, watermarking is automatically removed from your account , including from previously generated content in your workspace and all future generations , and the commercial use rights described in Section 8 apply.
The number of trial credits offered may change at any time and trial credits carry no cash value.
Refunds and Cancellations
The free trial exists so that you can evaluate output quality, platform performance, and suitability for your catalog before paying. Accordingly:
- Purchases of prepaid credit packs are final and non-refundable, whether credits are unused, partially used, or fully used, except where a refund is required by applicable law.
- Closing, cancelling, or deactivating your account , whether voluntarily or as a result of termination under Section 12 , does not entitle you to a refund of any remaining credit balance. Unused credits are forfeited on account closure.
- Credits consumed by failed generations are automatically returned as described in Section 5 , this is handled as a credit reversal, not a monetary refund.
- If you believe you have been charged in error (for example, a duplicate payment or a payment debited without credits being added), contact us at studio.support@faishon.studio within 7 days of the transaction and we will investigate and, where verified, refund the erroneous charge to the original payment method.
Content Ownership and Licensing
Your uploads. You retain all rights you hold in content you upload. By uploading, you grant us a limited license to host and process that content solely to provide the services, as further described in our Acceptable Use Policy.
Generated outputs. Subject to your compliance with these Terms, the Acceptable Use Policy, and payment of applicable fees, you receive full rights to use your generated images and videos for any lawful purpose, including commercial use across e-commerce marketplaces, advertising, social media, and marketing , without attribution and without further payment to us. Outputs generated with trial credits are subject to the watermark restrictions in Section 6. Your rights in generated outputs are conditional on your rights in the underlying uploaded content, as set out in the Acceptable Use Policy.
Our platform and asset library. The platform, its software, and the models, poses, backgrounds, styling presets, and other creative assets made available within it (our "Asset Library") remain the intellectual property of 3rd i Visuals Pvt. Ltd. You may use Asset Library elements only within generated outputs, not as standalone assets.
Saved brand models. Saved models you create or configure in your account are exclusive to your account and are not made available to other users.
AI Disclaimer and Output Limitations
Faishon.studio uses AI models, including third-party AI infrastructure, to generate outputs. While we strive for photorealistic, catalog-quality results, generative AI has inherent limitations:
- Results vary with input quality, garment type, and model capabilities.
- Outputs may not perfectly reflect real-life fabric behaviour, draping, or fit , particularly for garments such as sarees, dhotis, and unstitched or heavily draped clothing.
- We do not guarantee that any specific generation will meet your creative expectations, and we do not guarantee 100% accuracy, consistency, or realism.
Content may also be automatically declined or blocked by AI safety systems; in such cases the failed-generation credit policy in Section 5 applies.
Data Storage, Download, and Retention
You can download all generated content from your workspace. Your uploads, shoots, saved models, and generated outputs are stored on the platform unless you delete them or your account is deactivated under Section 11. We use third-party cloud infrastructure to host and process content. Generated content and associated logs may be retained for platform operation, safety screening, abuse investigation, and legal compliance, as described in our Acceptable Use Policy.
Inactive Accounts
If your account is not accessed for a continuous period of 12 months, we may deactivate it. We will send at least 30 days' advance notice to your registered email address before deactivation. Upon deactivation, any remaining credit balance is forfeited and stored content may be permanently deleted. Logging in to your account at any time before the deactivation date preserves your account and balance.
Termination and Suspension
We reserve the right to suspend or terminate your access if you violate these Terms, the Acceptable Use Policy, or applicable law, or if your use compromises the integrity, safety, or experience of the platform or other users. Severe violations of the Acceptable Use Policy result in immediate termination without refund of remaining credits. You may stop using the platform and request account deletion at any time; unused credits are not refunded on voluntary account closure.
Platform Availability and Maintenance
We aim to provide a reliable, continuously available service but do not guarantee uninterrupted access. In the case of scheduled downtime or major updates, we will make reasonable efforts to notify users in advance via email or in-app notice.
Limitation of Liability
To the maximum extent permitted by law, Faishon.studio and 3rd i Visuals Pvt. Ltd. are not liable for any indirect, incidental, consequential, or special damages, or for any loss of profits, revenue, data, or business, arising from:
- User-uploaded content or misuse of the platform;
- Output dissatisfaction due to AI limitations described in Section 9;
- Downtime, bugs, third-party service failures, or other technical issues.
To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the platform shall not exceed the total amount paid by you for credit purchases in the 12 months preceding the event giving rise to the claim.
Indemnification
Your indemnification obligations relating to uploaded content, generated outputs, and violations of platform policies are set out in Section 3 of the Acceptable Use Policy and apply to these Terms as if set out here in full.
Changes to These Terms
We may update these Terms from time to time to reflect changes in our platform, applicable law, or business practices. The "Last Updated" date above reflects the most recent revision. Where changes are material, we will make reasonable efforts to notify users via email or in-app notice. Continued use of the platform after updates constitutes acceptance of the revised Terms.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
